Class Action Against Family Violence Laws

The slow simmering unrest amongst dispossessed parents and children is building steadily worldwide. Increasingly governments are permitting the misuse of illegal Domestic Violence laws to separate parents from their children and property, which is wreaking intolerable havoc amongst our communities.

However slowly but surely, the restless victims and their children are starting to challenge the immoral and illegal actions of our dis-interested legislators, who have allowed these draconian laws to be passed with their stamp of approval.

In the Australian State of Tasmania, a group of concerned parents both men and women, have joined together into a fighting force and have set out to overturn these destructive Family Violence laws, claiming damages for the immense damage they have caused their families and communities. There action group is called J.A.I.L.Inc. (Juries Against Illegal laws) and their spokesman Ray Escobar is our first guest this week.

J.A.I.L. Inc has launched a class action against the Tasmanian Government and have hired a legal team headed by Dr John Walsh of Brannagh, who is our second guest on the show this week. The good Doctor is Australia’s most eminent  authority on the Australian Constitution, holds a degree in Criminal Law and has been a Magistrate. On the 4th February 2010 the Federal Court of Australia, Tasmanian Registry, date stamped the writ against the Tasmanian Government.

J.A.I.L. Inc. amongst other things is seeking damages of $200,000,000.00 as well as the complete repeal of the Tasmanian Family Violence Act of 2004. Because these illegal Domestic Violence laws are responsible for the current large scale destruction of so many parent/child relationships worldwide, there is no doubt many are watching globally to see how this action will unfold.

Shameful Political Apathy

When dealing with issues relating to the health and well-being of the men and boys of our society, the silence from our legislators is deafening. Apart from paying lip-service to the importance of sound policies to ensure the protection of all of the nations citizens, our legislators are completely indifferent to the plight of the male half of our citizenry.

This is especially noticeable in the area of Family Law, Domestic Violence, Child Support, Men’s Health, Boys Education, and Suicide prevention. Today we speak with Greg Andresen of (Men’s Health Australia) and Sue Price of the (Men’s Right Agency) about these issues and the lack of urgent government attention to the desperate needs of our fathers, husbands, brothers and sons, as they face an ever increasing level of persecution and neglect.

Jailed For Trying To Be a Dad

Today we play part 1 of an in-depth 2 part interview with a father who has been jailed several times for such dangerous crimes as sending a birthday card to his daughter and for daring to watch his son play school sport.   

Rick, not his real name for legal reasons, joins us to tell us his story in the hope it will alert people, as to how easy it is to spiral into an impossible situation which severely punishes you for daring to attempt to remain in your children’s lives.    

This fathers’ plight clearly exemplifies everything that is wrong with the worldwide family justice system, now a multi billion dollar industry of which the symbolic head is the Family Court.     

We sincerely hope that this father’s experience is another wake-up call to all those mothers and fathers who think this could never happen to them.

We hope everyone seriously re-assess their perceived legal rights as a parent, because the truth is you have none. I repeat Parents do not have legal parenting rights.

Unfortunately the mistaken believe in these perceived rights, cause many parents to seek justice in a family justice system which does not offer due process of law and is more interested in serving the economic well-being of thousands of meddling bureaucrats. A corrupt system that has now grown into a multi billion dollar worldwide industry.

Unless you have made a pre-emptive first strike or have a million dollars to spare, the Family Court will do nothing for you except sever your relationship with your children and confiscate your family wealth, thereby stealing your kids’ inheritance. It is a social engineering Hell Hole to be avoided at all cost.

Ask anyone who has been there, they will all tell you the end result will leave you emotionally and economically destitute. The stealing of children is a crime against humanity and fighting this crime in the family courts will only make your situation impossible. If you decide to go this way and persist in seeking equality, justice and your human rights, it will cause you to spiral into the devastating situation this dad finds himself in.

The Parental Alienation Debate

With an ever growing body of evidence supporting the existence and devastating effects of the Parental Alienation Syndrome (PAS), we felt it necessary to again raise awareness to this debilitating disorder. Today we enjoy an informative discussion  with Dr Ned Holstein MD MS, who is the founder of the prominent American family support group Fathers & Families.  

The website of Fathers & Families describes the disorder in the following manner.    

“Parental Alienation is a disorder that arises primarily in the context of divorce/separation and/or child-custody disputes. Its primary manifestation is the child’s campaign of denigration against a parent, a campaign that has no justification. It results from the combination of a programming (brainwashing) of a parent’s indoctrinations and the child’s own contributions to the vilification of the targeted parent. Parental Alienation is also sometimes referred to as “Parental Alienation Disorder” or “Parental Alienation Syndrome.” 

“Few family law cases are as heartbreaking as those involving Parental Alienation. In PA cases, one parent has turned his or her children against the other parent, destroying the loving bonds the children and the target parent once enjoyed”.

“Fathers & Families wants to ensure that the DSM-5 Task Force is aware of the scope and severity of Parental Alienation. To this end, in December we asked our supporters to write the Task Force to urge them to consider including Parental Alienation Disorder in DSM-5. As usual, your response was overwhelming. It also helped lead to progress–while as expected the newly-released draft version does not specifically include Parental Alienation Disorder, the DSM-5 Task Force has now listed Parental Alienation Disorder among the “Conditions Proposed by Outside Sources…that are still under consideration by the work groups.”

Department of Child Stealing

This is a week where community alarm bells should have been ringing loudly. It’s a week when the Australian Government released a report showing that in the year 2009, more than 210,000 children were the subject of child protection notifications, in excess of 33,000 were the subject of one or more substantiations, over 35,000 were on care and protection orders and government agencies removed more than 34,000 children from their biological parents.

These figures are especially troubling since on the following day the NT coroner declared the death of a 12 year old girl ,who was under state protection there, as ‘appalling’ and ‘needless’.

Today we speak to one of those biological parents ‘Daniel’, a distraught father who has spent the past 13 years desperately trying to have his son returned to his care and protection, following the boys’ removal from his parents’ care by Docs of NSW,  on the bases of allegations of abuse and neglect, which were subsequently proven to be false.

The desperate emotional trauma of having their son removed on the basis of false allegations, eventually resulted in the marriage breakdown, and this father is almost at the end of his tether at not having had contact with his long lost son for many years.

More questions urgently need to be asked in order to establish the possible underlying causes for such a disturbing high level of government involvement in the child stealing racket that appears to be taking place.

Of particular interest is the fact that the governments’ own reports show that tens of thousands of the nation’s children are removed from one or more of their parents every year with the help of a number of government agencies such as the Family Courts, the Domestic Violence Industry and the departments of community services.

Again our own investigations show the frightening speed and ease by which your biological children can be removed from your care, by any of these government agencies on the basis of the flimsiest of evidence, unsupported hearsay or vindictive false allegations.

‘Daniel’ not his real name for legal reasons joins us today to tell his story in order to warn others about the dangers posed to parent/child relationships by  those government agencies that parade under the nauseating ‘Best Interest of the Children’ Mantra, as they happily remove your children.

Myth Busting Ladies

Highly respected Canadian journalist Barbara Kay of the National Post, opens the show and speaks candidly about how the extreme international feminist movement has used and promoted the myth that the Montreal Massacre is representative of all male behavior towards females.

Barbara correctly points out that this shocking event has been hijacked by the White Ribbon campaign organizers and used to label all men as violent dangerous, psychopaths, which needs to be condemned and exposed for the malicious, hysterical hate campaign it really is.

We also speak with Sue Price from the Mens Rights Agency, who provides us with an update of Child Support and Family Law matters in Australia as they currently apply, and about the pending changes considered by the Rudd government.

What Is Family Violence?

This week much media attention is given to the subject of Family Violence and Abuse. While $40 million of taxpayer dollars have been spent on the hysterical  WRD campaign, which by definition promotes the false perception that violence is only perpetrated by men against women, the Rudd Government has not spent one cent on one third of the victims, which happen to be men.  

The insidious WRD campaign which has now infiltrated our schools and is being used to indoctrinate our children, does nothing except cause our daughters to be filled with hate for our sons, and fill our sons with false guilt just for being male. 

However, armed with a dozier of more reliable factual research that indicates a large percentage of the victims are in fact males, men have finally launched the more credible 1in3 campaign.  First up we speak with the Senior Researcher and spokesperson for the One in Three Campaign, Greg Andresen, who exposes a series of falsehoods and misinformation being put forward by the Domestic Violence industry, in order to deceive an unsuspecting public into believing that only men are perpetrators and only women are victims of Domestic Violence.  

Next we speak with Sue Price from the Mens Rights Agency, who draws attention to the way the Rudd Government, which is hell bent on taking us back to the dark old days of the disgraced Nicholson era, is calling on noted anti shared parenting apologists to provide advice to the Government on how to remove the notion of shared parenting.   

We close the show with Warwick Marsh from the Fatherhood Foundation, who gives a glowing account of the success of last weeks’ International Mens Day. This event was celebrated around the world and contrary to the usual negative media portrayal of men, this positive image of men is now seen by many as one of the important building blocks of the long road back towards achieving justice and equality for men.

Threats To The Family

We start the program interviewing Barry Maley, who is a Senior Fellow at the Centre for Independent Studies in Sydney. Barry has released a report Family on the Edge – Stability and Fertility in Prosperity and Recession in which there are surprising findings leading to some major recommendations. Birth rates have been studied between a low point of 2001 and a recent high point of 1.93 per woman in 2008. The increase is strongly associated with the rising prosperity of that period.  With the financial threats and the continuing prevalence of children bei ng born to single mothers Barry argues for a change in family law and policies to encourage family stability. This would be a major factor in being able to sustain the buoyant birth rate.

Our second interview is with Dr Elizabeth Celi, well known Psychologist and social commentator who in the course of her work in mental health has encountered examples of domestic abuse which are sometimes too subtle to affect our sensibility. Elizabeth discusses recent television advertisements that would cause immediate offence if a female character were to be substituted for the male character in the script. We also talk about communication strategies and ways that can improve relationships and mental health.

Our final interview is with Sue Price from the Men’s Rights Agency. Sue has been conducting a survey on the Family Relationship Centres and we discuss progress with the survey. One of the problems that has been identified so far is with regard to a particular psychological theory that may be imposed by the Centres. We might have expected that the Centres would use the Government money to mediate and listen to the parties rather than impose a particular theoretical approach on the parties in dispute.

In coming weeks we will be presenting interviews obtained at the National Men’s Health Gathering held in Newcastle last week, at which Dads on the Air was represented by Peter van de Voorde and Greg Andresen.

The Menace of Extreme Feminism

This week we look at the struggle of the community to deal with the outrageous effects of extreme feminist dogma on our daily lives. Much of the discourse centers around myths and rogue statistics which paint a very negative picture of the men and boys in our communities.

This propaganda machine which rolls out a production line of inaccurate information of a misandrist nature, is being used as a template to formulate anti male government policy, and which is proving so detrimental to the health and well-being of the males in our society.

Unfortunately our leaders ignore community calls for them to more aggressively enquire about the accuracy of the anti male information they receive, and on which they base their judgement and ultimately cast their vote.

We recently saw our Australian federal opposition leader Malcolm Turnbull, make the mistake of not checking the accuracy of the information presented to him. He did this to his own detriment and is now paying the political price for ignoring the need for scrutiny.

Yet when Senator Steve Fielding goes on a search for the truth regarding the global warming climate debate, he is ridiculed by fellow politicians and the media, for doing so. While at the same time government members, like lemmings jumping over a cliff, blindly toe the anti-male line and continue to refuse to question the accuracy of the extreme feminist dogma that permeates our corridors of power, and continue to vote against equality and justice for men.

Amfortas together with other concerned citizens, has put together an excellent series of podcasts on the need for accuracy in reporting, on what can only be described as the human rights abuses of men and boys, and explains how, when and why, this is happening.

The Mandarins and the Masses

Over the past week father’s activists around Australia have been appalled by announcements from the Australian Labor government that it intends winding back the 2006 reforms to family law which promoted more cooperative arrangements after divorce or separation.

The government is conduction three separate inquiries into family law, inappropriately linking the inquiries with domestic violence. Not one of them consults the views of fathers or even the general public. There could be no clearer case of the mandarins regarding the great unwashed with contempt and not trusting their opinions, because after all there is strong public support for shared parenting.

Against this background, this week we play samples from the compelling podcasts compiled by a private practicing psychologist with 25 years experience who is driven by his own experiences and the experiences of many of his clients. He goes by the handle Amfortas, after the keeper of the Holy Grail. “I am a Men’s rights activist who is fighting against the excesses of feminism and the deleterious affects they are having on our public policies, particularly as they affect families and children,” he says. “I am not at all embarrassed by the use of the term Men’s rights, even if its unfashionable. Men’s rights are part of human rights.”

Democracy At Work

This week we range across a wide variety of subjects, talking first up with the ever lively author of a new book on becoming a dad, Be My Baby Neil Humphreys. From the cheery to the rational, we then talk with Sue Price, the founder of the Men’s Rights Agency, arguably the most articulate supporter, of the rights of men in our modern society.

This is followed by a fascinating interview with academic Dr. Michael Woods  UWS, as we take a revealing look at the way the real statistics on Domestic Violence and Child Abuse have been kept from the general public, and how many Government Policies appear to be formulated based on inaccurate information.

We close the show talking with Benjamin Easton a Political Busker, who is participating in a demonstration outside the Bank of New Zealand, protesting their outrageous portrayal of all men as bashers and all women as victims, clearly themselves the victims of domestic violence hysteria. Somewhere along the line they forgot that half their customers are male and most of them object to being portrayed as Neanderthals.

How Family Courts Contribute to Family Destruction

This week we present a compelling interview with a separated Australian mother of three, whose ex-husband successfully resorted to all the malicious tools available to both parents under the family justice system. Her appalling experience as a victim of the system will resonate with many fathers, as statistically these very same tactics are mostly used by mothers in order to separate fathers from their children.

Diana” (not her real name because we’re prevented by law from using her real name), describes in great detail how her ex-husband was able to use false child sex abuse allegations and take out an AVO against her, in order to separate her from her children, safe in the knowledge he would not be punished as a result of his perjury.
 
Our Prime Minister made it known in no uncertain terms recently, that “those that trade on the tragedy of others should rot in jail” and in fact “should rot in hell”. In his view, those that do so, “are engaged in the world’s most evil trade and represent the absolute scum of the earth… the lowest form of life”. 
 
Well Mr Rudd, we have a whole industry trading on the tragedy of others, that has done so with the blessing of successive Australian Governments for the past 35 years. This industry has wreaked absolute havoc and destroyed millions of lives during its long reign of terror against separating parents and their children, yet hardly a whisper of concern is raised by our legislators.
 
This week’s program again illustrates how easy it is for both responsible fathers and mothers to be separated from their children when a malicious, vindictive ex-partner decides to make use of false child sex abuse and domestic violence allegations, in order to obtain valuable time to set in motion the insidious parental alienation process, which turns children against their own family.

The perpetrators of this insidious practice are free to do so under the watchful eye of the judiciary, in the perjury-friendly atmosphere of our family courts, and ironically, somehow this is seen to be “in the best interests of our children”.

Men's Health and Rallying Forces

Our Men, Our Community

This week we will be talking with two of the country’s leading experts on men’s health. First up Prof John Macdonald, who is president of the Australasian Men’s Health Forum, Co-Director of the Men’s Health Information and Resource Centre at the University of Western Sydney and one of the Federal Government’s Men’s Health Ambassadors. He has been closely involved with the government’s community consultation process for the development of the first National Men’s Health Policy, and related matters around men’s health in Australia. He will be bringing us up to date with developments.

John Roberts is the chair of the organising committee for the Men’s Health Gathering to be held at Newcastle University in October this year. John also works for the Benevolent Society in the Hunter Valley of NSW and runs their MARS (Men Accessing Resources & Services) Program which has produced some fabulous resources for blokes such as the Our Men, Our Community posters, the Blokes Booklet and the Blokes Card. He also works with community organisations around the Hunter and Central Coast regions to encourage them to become more “men-friendly”.

We close the show talking with leading lobbyist Sue Price from the Men’s Rights Agency about the women’s groups organising rallies outside Family Courts amidst concern the courts may be too generous to dads!

Gender-Neutral Approaches to Domestic Violence

In the social justice arena, two small European countries appear to be way ahead of the pack, and Dads on the Air has been among the first to report these important historic developments to the English-speaking world. First, on the 10th of March we reported on the new “50/50 Equal Shared Parenting Time” laws in Belgium, and now we are pleased to report that the Dutch Government has finally recognized the need to provide domestic violence shelters for abused men.

First up we speak with Joep Zander, who is a well known author, artist and fathers rights activist in the Netherlands. He presents his view of the new DV shelters, acknowledging that because it is still very early days he has some reservations about the scheme. However he hopes the shelters will turn out to be successful in providing a much needed escape for men from their violent partners or families.

Next we speak with Patricia Gho of Stichting Wende, director of the men’s shelter in the Hague. Commenting on the radical change in Dutch Government thinking that led to the trial, she states that “the Government simply could no longer ignore all the data that has for many years shown that there is a real need to also provide shelter for the abused men in our community”.

Bringing the issue closer to home, last up we speak with Paddy Murray, the Buddhist chaplain from Goulburn prison. Mr Murray has done some interesting development work in violence-prevention in Campbelltown with both men and women. He ran the first violence prevention course for women, which unfortunately is no longer in operation. His approach, which he calls “peaceful relating”, is to move beyond gender in violence-prevention work, arguing that the gender lens is just a distortion that does not help much with the work.

Divorced From Reality

We are delighted to have the author of Taken Into Custody: The War Against Fathers, Marriage, and the Family, Dr Stephen Baskerville, on the show once again.

No one has done more to expose the ideological war against fathers by the welfare, family law, domestic violence and child support industries as Dr Baskerville. While those impacted by these industries, many of whom have seen their lives and their children’s lives destroyed, know all too well the disastrous impacts of the current reigning ideologies, separated fathers are traditionally ridiculed. With his academic credibility and forecefulness of personality, Baskerville has been able to articulate the shocking damage being wreaked not just on fathers and their children but on society as a whole.

In Australia, the Labor Party, now in power, created many of the country’s most despised and destructive institutions, including the Family Court and the Child Support Agency. The conservatives did nothing to stop their ever increasing power.

We last interviewed Dr Baskerville in 2007 on the publication of Taken Into Custody. This week we catch up with activities since, including the establishment of his own blog.

The Perils of Ideology

In May 2007 Dads on the Air interviewed the founder of the world’s first refuge for battered women, Erin Pizzey. This interview was circulated far and wide, making it one of the most publicised broadcasts in DOTA’s history. As the Australian Government has recently been raising the issue of domestic violence from a one-sided ideological perspective, including the establishment of the National Council to Prevent Violence Against Women and Children, we thought it would be timely to re-broadcast the Erin Pizzey interview to try and bring some balance and rationality to the domestic violence debate.

Also on today’s program we feature another wonderful contribution by Mark Sutton from Liberal Arts Radio in the US. Alec Baldwin took a lot of heat after an angry voicemail to his daughter was leaked back in 2007. In his recently released book about Parental Alienation, A Promise to Ourselves, he confides that he was suicidal after the voicemail incident. Susan E. Block, a family law attorney and the former Administrative Judge of the Family Court of St. Louis County, looks at the problems facing non-custodial parents as well as new solutions that are being implemented in the US state of Missouri. European Update

John Forsyth is a journalist based in Scotland who worked for the BBC in London for 10 years before returning to Scotland to become Political Editor of Scotland on Sunday newspaper. He has recently resumed freelancing for newspapers. John has taken some interest in the Scottish Government’s persistence with a gender-based analysis of domestic abuse to provide 10s of millions of pounds in funding for support groups for female victims of domestic abuse and violence and zero for males in the same situation. The latest 2007-8 domestic abuse statistics were published recently with a government press release saying police reports of domestic abuse had gone up 2%. Somehow they managed to gloss over the fact that police reports of women as victims of men had fallen while incidents of males on the receiving end had gone up by 12%, as they have in each of the last 8 years.

Jiri Fiala is the founder and director of the Czech Republics’ fathers group K213. Jiri has been desperately trying to obtain contact with his two children, which the Czech Courts will not support. After taking his case to the European Court of Human Rights, who incidentally ruled in his favour, the Czech Family Court still refuses to act upon the directions of the European Court of Human Rights, and will not enforce his legal contact with his children.

Two Sides to Every Story

There are two sides to every story, but when it comes to gender issues including domestic violence and shared parenting, the Australian public are only hearing one side.

Much of the Australian media has completely neglected to point out that there is a great deal of debate academic and otherwise over the massive taxpayer-funded domestic violence industry and its portrayal of men and fathers as abusers and women as victims.

The Labor Party has now been in power for a year, and the anti-father anti-male propaganda machine is in full swing. The public has been inundated with horror stories of evil men bashing women and how the extremely modest reforms by the previous government to dilute the extreme anti-father bias of our family law system are allegedly placing women and children in danger.

Resilience

As always, Dads On The Air is covering a lot of ground this week. We begin by talking to author Maggie Dent about her new book, Real Kids in an Unreal World: Building Resilience and Self Esteem in Today’s Children. Then we talk with Michael Woods, Senior Lecturer with the Men’s Health Information and Resource Centre at the University of Western Sydney, on the controversy surrounding White Ribbon Day. Many critics are now expressing concern over the social consequences of the repeated linking of men with violence in taxpayer-funded public campaigns and the inflamed misuse of statistics to bolster an ideological position which paints men as violent patriarchs. We’ll also be taking a look at the demise of the Federal Magistrates Service in Australia, created in a sense as a counterbalance to the Family Court. While many questions remain over the failure of reactionary elements within family law to embrace shared parenting, the Magistgrates Service was generally seen as faster, fairer and less expensive.

We speak with Habib about his new book My Story - The Tale of a Terrorist Who Wasn’t, his experiences in Guantánamo, and how he has managed to adjust back to his life as an Australian father and husband.

We also present Maggie Hamilton’s inspirational keynote address from the MAN National Conference in Fremantle titled Capturing the public imagination: securing a better future for our men and boys.

Social Justice: Think Twice

The Australian Family Association is campaigning against the proposed changes to NSW legislation that would remove the word ‘father’ from birth certificates and get rid of the term ‘paternity leave’. We are pleased to have their spokeswoman Angela Conway on the program. “We oppose the change, it is part of the national and international picture of eroding the traditional family and the concept of a natural parent,” she said. “The social science evidence is pointing us in the other direction; that natural parents, both mothers and fathers, are vital to their children.

We are also delighted to have domestic violence counsellor and expert Toni McLean on the show. She has had the courage and integrity to genuinely think outside the square when it comes to violent couples and the best way to promote healthy relationships. Together with supportive and experienced group facilitators, her Think Twice program offers a complete range of options for individuals and couples experiencing difficulty in their relationships from normal conflict through to all forms of abuse, as well as physical violence.

We close the show with the ever entertaining Richar’ Farr, a leading figurehead in the international fatherhood movement. He is the founder of KRights Radio and the nationally syndicated program The Message. Richar’ describes his new internet radio station as “a town hall meeting on radio.” He calls it Kids’ Rights Radio - KRights for short. The unique station began its unusual and compelling broadcast on Aug 1, 2004, and is now on the air 24 hours a day, 7 days a week.

We also talk with John Flanagan about the upcoming Dads4Kids Rally at NSW Parliament House to protest the removal of the word ‘father’ from birth certificates.
